I can hear it now:

There may be some slack to cut the guy, since he's not a good English speaker, but calling 911? I dunno.

One thing's for certain: I don't see guys who call the police to ask for help about their missing oj being the kind of guys who in the 1840's struck out from St. Louis and survived crossing the Great Plains:

I'll write the same as I did with that woman who called 911 when she didn't get her nuggets and no refund either.

First of all the customer should be given the order (s)he orderd. If the order can't be processed then te customer must be informed before payment takes place. If the customer already paid (s)he should be given the choice of a refund or alternative product (without extra costs). Incase the product was given to the customer but incomplete the order should be corrected accordingly. If not: offer alternatives or a refund.

Anyway: if the clerk/waiter/... refuses to give a refund or other fair alternative the manager should talk with the customer and try to offer him or her a fair solution. If the manager refuses (a refund) then it's theft and the customer can call the police.

However, you do not call 911 except for emergencies. Theft is not an emerency unless it's something like a robbery (ea theft by force) etc. Incase you find out theft and the robber is either long gone or going nowhere (the manager won't run away with your money or threaten to harm you.. I'd hope...) you call the police on their local line. Depending on were you live they may have a special phonenumber that redirects your call to the nearest policestation (like overhere in the Netherlands) or you just look up the number for the local police station yourself. Explain the situation, they will (probably) come over and resolve the situation.

911 / 112 / 999 / enter-emergency-number-here / is for emergencies only! Duh.

As far as the guy is concerned:
If he had take a seat and his drink was taken from him it would be his problem (watch your belongings). If it happend at the counter then it would most likely be fair to give a "new" drink. as it should be clear to the clerk/waiter/.. that he's not being scammed. Said person probably saw with their own eyes that somebody else took it... the chanche of both the customer and employee not watching the service that just switched hands (owners) moments ago is rather slim I'd think...

If I were ordering something at a counter, been given my order and I turn around for some reason or need to bend over (to reach for a bag on the ground for example) and turn my face back to the counter/employee a moment later to notice something went missing I wouldn't be amused and expect the employee to give me what I paid for. On refusal I'd ask for a superior (manager) and if I'm getting nowhere at all I'd first threaten to call the police for theft and then I'd probably do so. But I haven't been in such a situation so that's just speculation I guess. And I doubt most people will ever end up in a simular situation...

The guy is trying to live his american dream, is a true believer of the bill of rights and so on, he got my support.

Besides, any anglosaxon screwhead who makes fun of the not-english speakers despite the fact he, most than likely, only speaks english, and a bad english (and lives in a van with a blonde meth adict called with a hilarious double name) deserves a squad of swats fast roping through the ceiling of his fast-death chez restaurant
